General Terms and Conditions of ECOMMA HONG KONG LIMITED

§1 Applicability to Entrepreneurs and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (§ 13 BGB).
§2 Conclusion of a Contract, Storage of Contract Text

(3) The presentation of goods in our online store does not constitute a legally binding contractual offer but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

The order process includes the following steps:

3) Checking the details in the shopping cart

Before submitting the binding order, the consumer can return to the webpage where the customer data is recorded and correct input errors or cancel the order process by closing the Internet browser. §3 Prices, Shipping Costs, Payment, Due Date
(1) The stated prices include the statutory value-added tax and other price components. Additional shipping costs may apply.
(2) The consumer has the following payment options: cash on delivery, direct debit, PayPal, credit card (Visa, Mastercard, American Express).
(3) If we deliver by cash on delivery, the purchase price becomes due upon receipt of the goods.
§4 Delivery
(1) Unless otherwise clearly stated in the product description, all items we offer are ready for immediate dispatch. Delivery takes place at the latest within 10 business days. In the case of advance payment, the delivery period begins the day after the payment order is issued to the bank executing the transfer, and for all other payment methods, the day after the contract conclusion. If the end of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.

(2) The risk of accidental loss and accidental deterioration of the sold goods only transfers to the buyer upon handover, even in the case of a mail-order purchase.

§5 Retention of TitleWe retain ownership of the goods until full payment of the purchase price.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for additional costs resulting from choosing a different delivery method than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise; in no case will you be charged fees for this reimbursement.
We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day you informed us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct costs of returning the goods.
